Failing to do so can lead to fines, penalties and reputational damage for the organisation. In this article, we\u2019ll explain what the right to work means and how employers can check an employee\u2019s eligibility to work in the UK in order to meet their legal requirements.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-the-right-to-work\">What is the Right to Work?<\/h2>\n\n\n\n<p>The right to work refers to a person\u2019s legal entitlement to be employed in a particular country. In the UK, this means the individual has the necessary immigration status, visa or citizenship to work for an employer. Employers must confirm this entitlement before employment begins.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"685\" height=\"295\" src=\"https:\/\/www.highspeedtraining.co.uk\/hub\/wp-content\/uploads\/2026\/03\/righttowrk2.jpg\" alt=\"Job interview \" class=\"wp-image-81724\"\/><\/figure><\/div>\n\n\n<p>A person may have the right to work in the UK if they are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A British or Irish citizen.<\/li>\n\n\n\n<li>A person with settled or pre-settled status under the EU Settlement Scheme.<\/li>\n\n\n\n<li>A non-UK national with a valid visa that permits work.<\/li>\n\n\n\n<li>A person with indefinite leave to remain or another form of settled status.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-right-to-work-laws\">Right to Work Laws<\/h2>\n\n\n\n<p>UK law requires employers to check that every employee has the legal right to work in the UK. Right to work checks must be completed before employment starts and, in some cases, repeated during employment if the individual has time-limited permission to work.<\/p>\n\n\n\n<p>Right to work legislation requires employers to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Conduct right to work checks before the first day of employment.<\/li>\n\n\n\n<li>Check original documents or use an approved online checking service.<\/li>\n\n\n\n<li>Ensure documents are valid and belong to the individual.<\/li>\n\n\n\n<li>Keep clear records of the checks carried out.<\/li>\n\n\n\n<li>Repeat checks where an employee has time-limited permission to work.<\/li>\n<\/ul>\n\n\n\n<p>There are several pieces of UK legislation that reference the requirement for employers to carry out right to work checks. These laws include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The Immigration, Asylum and Nationality Act 2006<\/strong> &#8211; this law introduced the legal duty for employers to prevent illegal working and established civil penalties for employing individuals without the right to work.<\/li>\n\n\n\n<li><strong>The Immigration Act 2014 <\/strong>&#8211; this law strengthened enforcement powers and compliance measures, increasing the scrutiny on employers and their right to work procedures.<\/li>\n\n\n\n<li><strong>Immigration Act 2016 &#8211; <\/strong>this law introduced criminal offences for knowingly employing illegal workers and tougher sanctions for repeat non-compliance.<\/li>\n\n\n\n<li><strong>The UK Borders Act 2007 <\/strong>&#8211; this law supports broader immigration enforcement powers and the data-sharing measures that underpin right to work compliance.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-risks-of-non-compliance\">Risks of Non-Compliance<\/h4>\n\n\n\n<p>Failing to carry out proper right to work checks can lead to serious consequences. It\u2019s commonly used by non-UK nationals with digital status. Important points about share codes include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They are generated by the individual via the <\/span><a href=\"https:\/\/www.gov.uk\/prove-right-to-work\/get-a-share-code-online\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">government website<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They are valid for 90 days.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They provide real-time confirmation of work permissions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They remove the need to handle physical documents.<\/span><\/li>\n<\/ul>\n    <\/div>\n        <h3>\n        Manual Document Checks        <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.highspeedtraining.co.uk\/hub\/wp-content\/uploads\/2015\/09\/down53.png\" alt=\"drop down menu\" width=\"24\" height=\"24\" \/>\n    <\/h3>\n    <div>\n    <p><span style=\"font-weight: 400;\">Manual checks may still be required where online checks are not available.
