The government has stated that the changes are intended to make data protection requirements clearer for organisations, support economic growth and innovation, improve public services and strengthen trust in the use of data.<\/p>\n\n\n\n<p>The legislation includes provisions to support the growth of digital verification services, expand Smart Data initiatives (such as Open Banking) and establish a National Underground Asset Register. Below are some of the most significant changes that organisations should be aware of. Note that this isn\u2019t an exhaustive list of changes, but it highlights the areas most likely to affect businesses, managers and compliance professionals:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-automated-decision-making-and-ai\">Automated Decision-Making and AI<\/h4>\n\n\n\n<p>One of the most notable changes relates to automated decision-making (ADM). Previously, organisations faced strict limitations when making decisions based solely on automated processing. This change is particularly relevant for organisations using AI-powered tools in areas such as recruitment, fraud detection, customer services and credit assessments.<\/p>\n\n\n\n<p>Under the new framework, organisations can use automated decision-making in a wider range of circumstances, provided that appropriate safeguards are in place. This includes ensuring individuals are provided with information about automated decisions that affect them, allowing individuals to challenge decisions and providing access to meaningful human review where required.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-subject-access-requests-sars\">Subject Access Requests (SARs)<\/h4>\n\n\n\n<p>The Act introduces greater clarity around how organisations should manage subject access requests. There is further clarification that organisations only need to carry out reasonable and proportionate searches, greater certainty around handling complex requests and a new \u2018stop the clock\u2019 provision, allowing organisations to pause the response period when additional information or clarification is required from the requester.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-legitimate-interests-and-lawful-processing\">Legitimate Interests and Lawful Processing<\/h4>\n\n\n\n<p>The Act introduces a new concept known as \u2018recognised legitimate interests\u2019. Under certain specified circumstances, organisations can rely on a recognised legitimate interest as a lawful basis for processing personal data without carrying out the traditional balancing test. The reforms confirm that scientific research can include commercial research activities and allow researchers to seek consent for broader areas of related research, rather than requiring consent for every individual project.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-international-data-transfers\">International Data Transfers<\/h4>\n\n\n\n<p>Many organisations rely on international data flows for cloud services, software platforms and business operations. The Act simplifies and clarifies certain aspects of the UK&#8217;s international transfer regime with the aim of providing organisations with greater certainty when transferring personal data outside the UK, while maintaining appropriate protections for individuals.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-complaints-handling-requirements\">Complaints Handling Requirements<\/h4>\n\n\n\n<p>A significant new requirement is the introduction of formal data protection complaints procedures. Organisations will need processes that allow individuals to raise concerns about how their personal data has been handled. Businesses may also be required to provide clear information about how complaints can be submitted and how outcomes will be communicated.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-cookies-and-tracking-technologies\">Cookies and Tracking Technologies<\/h4>\n\n\n\n<p>The Act updates rules relating to cookies and similar technologies. In certain low-risk situations, organisations may be able to use some storage and access technologies without obtaining explicit consent.
