Asbestos is an extremely harmful substance that can cause serious health consequences to anyone who disturbs or damages it. Under UK law, dutyholders are required to manage the risks of asbestos, as far as is reasonably practicable, to ensure that those with the potential to be exposed are protected. Under the law, dutyholders include anyone who is responsible for maintenance and repairs in non-domestic premises, such as building owners, and employers who carry out any work that is liable to expose employees, or others, to asbestos. The duty to manage asbestos applies to all non-domestic buildings, and communal parts of domestic properties, regardless of age. 

Managing asbestos is an essential process to ensure that workers, contractors and anyone else who may be impacted by your work activities can carry out their duties safely and effectively. Managing asbestos effectively is a complex process, and requires a strong understanding of the legal responsibilities outlined under the Control of Asbestos Regulations (CAR) 2012 for non-domestic premises and ‘common parts’ of multi-occupancy domestic premises.

Historic exposure to airborne asbestos fibres is the single largest cause of death to workers in the UK, and every year, over 5,000 people die from asbestos-related diseases. The risk of serious ill health is increased when work involving asbestos, or premises where asbestos is present, is not properly managed, and those involved are not adequately informed or trained to carry out their duties effectively. 

Those with specific responsibilities associated with asbestos management have a legal duty to comply with key legislation and fulfil their obligations under CAR 2012. Failure to comply with these requirements may result in action being taken against you by the HSE or other enforcement agencies. 

This Duty to Manage Asbestos (D413) course teaches you about the potential risks associated with managing asbestos and provides guidance on how to address these issues. It also outlines the roles and responsibilities of individuals involved in asbestos management in non-domestic premises and in ‘common parts’ of multi-occupancy domestic premises, and the requirements for all organisations, so that you can understand and fulfil your legal duties.

Module 1: Duty to Manage Asbestos: Introduction

This module introduces the aims of the training and the course syllabus. It also includes links to prerequisites and course resources. 

You are expected to have recently completed an Asbestos Awareness (Category A) training course. Find out more about our BOHS-endorsed Asbestos Awareness (Category A) training course.

Module 2: The Risks from Asbestos

This module examines the six different types of asbestos outlined under CAR 2012. It covers where asbestos-containing materials (ACMs) can be found and the activities that cause risk from asbestos. It also identifies the health risks associated with exposure and explains the term ‘friability’.

Module 3: The HSW Act 1974, MHSWR 1999 and CAR 2012

This module outlines the key legislation and guidance relevant to the management of asbestos. It specifically examines the key roles and responsibilities of dutyholders and the actions they must take to comply with certain regulations under CAR 2012.

Module 4: Further Legislation and Guidance

This module examines additional legislation and guidance relevant to the management of asbestos, including the Approved Code of Practice (ACoP) for working with and managing asbestos, the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR) 2013, the Construction (Design and Management) (CDM) Regulations 2015 and the Hazardous Waste Regulations 2005.

Module 5: Asbestos Surveys

This module outlines the three types of asbestos surveys (management surveys, demolition surveys and refurbishment surveys), before looking at the importance of defining the scope of the survey and providing information to the LARC. It also covers how the risks of asbestos are assessed using material assessment (MA) scores and priority assessment (PA) scores to support management actions for managing known or presumed ACMs in non-domestic premises and in ‘common parts’ of multi-occupancy domestic premises.

Module 6: The Asbestos Register

This module explains what the asbestos register is, and outlines the information that should be included for each known or presumed ACM. It examines which format of register is suitable for which business and the importance of maintaining the asbestos register. It also outlines how to determine when reinspections should take place.

Module 7: The Asbestos Management Plan

This module examines the key components of an AMP. It also outlines the general requirements for asbestos management within an organisation to ensure that key responsibilities are met, before looking specifically at the roles and responsibilities of dutyholders. It also discusses the costs of not managing asbestos, emergency procedures and the EM1 flowchart.

Module 8: Plans of Work and Licences

This module discusses the importance of plans of work (PoWs), when they are required and what should be included in them. It provides detailed information regarding the requirements for asbestos work (licensable work, non-licensed work and notifiable non-licensed work). Finally, this module covers procuring a LARC, assessing competence and the certification, training and licences required for those working with asbestos. 

Module 9: Licensed Asbestos Removal Contractors

This module explains the process for selecting and appointing contractors, while also outlining the information that should be provided to contractors to ensure works can be carried out safely. It also looks at the requirements for notification and when a waiver might be granted for licensed asbestos works.

Module 10: Enclosures and Certification

This module examines the safety requirements for asbestos enclosures. It also explains the options for decontamination units, the requirements for asbestos waste removal, the different types of air monitoring and the four-stage clearance process.

Module 11: Summary and Resource Pack

In this final module of the course, you will have access to all the module summaries shared throughout the course, alongside a legal responsibilities information pack, which can all be downloaded and printed out to keep as a reference following your training.

An online assessment is taken upon completion of the training material. You will be asked 40 multiple-choice questions with a pass mark of 80%. The answers are marked automatically, so you will know instantly whether or not you have passed. If you don’t pass the first time, you can take the test as many times as you need with no extra charge.

Are there any prerequisites to taking this training course?
